Defendant James Lee Bullock was indicted for first degree murder. On May 10, 1976, the case was tried and the jury returned a verdict of guilty of second degree murder. The defendant was sentenced to life imprisonment at hard labor without benefit of parole, probation or suspension of sentence for 40 years. An out-of-time appeal was granted, 435 So.2d 446.
