KENNEDY Justice.

Appellant was convicted of aggravated rape. The trial court assessed punishment at 35 years in the Texas Department of Corrections. On original submission, we reversed appellant's conviction in an unpublished opinion, finding fundamental error in the trial court's charge to the jury. On April 10, 1985, the Court of Criminal Appeals remanded this case to us for further proceedings consistent with the opinion in Almanza v. State...
