HISTORY OF THE CASE

Defendant, Roy Hartman, was charged by grand jury indictment on July 1, 1982, with the second degree murder of Dean Hohn, a violation of La.R.S. 14:30.1. On October 12, 1982, defendant was formally arraigned and entered a plea of not guilty. On June 22, 1983, defendant withdrew his former plea of not guilty and entered a plea of "not guilty and not guilty by reason of insanity." The defendant properly waived trial by jury...
