Defendant Gary Ashley was charged by bill of information with two counts of attempted first degree murder, LSA-R.S. 14:27 and 14:30, and one count of armed robbery, LSA-R.S. 14:64. He pled not guilty and was tried by a twelve-person jury which unanimously found him guilty on two counts of attempted second degree murder, LSA-R.S. 14:30.1 and 14:27, and the armed robbery count.
