This is an appeal from the district court's grant of summary judgment for petitioning creditors in an involuntary bankruptcy proceeding. Jurisdiction in the district court was based upon 28 U.S.C. Section 1334. The bankruptcy proceedings were withdrawn from reference to a bankruptcy judge after the filing of the petition and the appointment of the Trustee in bankruptcy, and reassigned to the district court.
