JOHNSON, Circuit Judge:

The instant appeal is the direct result of a thwarted plan to overthrow the government of Haiti.1 Defendants Raymond Ramirez and Claude Perpignand were indicted on charges of conspiracy to violate the Neutrality Act (Count 1 — 18 U.S.C. § 371)2 and actual violation of the Neutrality Act (Count 2 — 18 U.S.C. § 960).
