Plaintiff, Phyllis Stern, filed an action in redhibition and a suit for breach of contract arising from the sale of a mink jacket. The trial court dismissed the action in redhibition as prescribed and, after consideration of the merits, dismissed the plaintiff's action for breach of contract because the amount of damages recoverable for the breach of contract was equal to the amount attributable to the plaintiff's use of the jacket.
