This case arises on the application of the National Labor Relations Board (Board) for enforcement of an order directing the company to cease and desist from the conduct proscribed by Sections 8(a)(1), (3), and (5) of the National Labor Relations Act (the Act), 29 U.S.C. §§ 158(a)(1), (3) and (5) (1982), to bargain with a union that had obtained a card majority, and to reinstate and make whole an employee...
