James Conerly was charged by bill of information with one count of theft of property valued at $100 or more but less than $500.00. He pled not guilty and elected to be tried by a jury. The jury returned a verdict of guilty, and, after a sentencing hearing, the trial court ordered defendant to serve two years in the custody of the Department of Corrections.
