G.R. COOK, J.

Following a bench trial conducted in the Washtenaw County Circuit Court, defendant was convicted of breaking and entering an occupied dwelling with the intent to commit larceny. MCL 750.110; MSA 28.305. Defendant was sentenced to three years probation and ordered to pay costs and make restitution. Defendant now appeals as of right.
