PER CURIAM.

A jury found appellant guilty of driving while intoxicated. Tex.Rev.Civ.Stat. art. 6701l-1 (1979 Tex.Gen.Laws, ch. 682, § 3 at 1609). The court assessed punishment at incarceration for forty-five days and a $500.00 fine, but imposition of sentence was suspended and appellant was placed on probation.

In one of his two grounds of error, appellant contends the trial court erroneously excluded the testimony of a defense witness.
