Appellant Porter serves as the elected probate judge of Calhoun County. In 1979, the General Assembly created, by local act, the Small Claims Court of Calhoun County. Ga. Laws 1979, p. 3121 et seq. Section 2 of this Act provided that "the judge of the Probate Court of Calhoun County shall serve ex officio as the judge of the Small Claims Court of Calhoun County."
