CURETON, Judge:

This is an action for malicious prosecution. After the presentation of evidence, appellant Williams moved for an involuntary non-suit and a directed verdict which were denied by the trial judge. The case was thereupon submitted to the jury which returned a verdict in favor of respondent Melton. Williams then moved for judgment notwithstanding the verdict or, in the alternative, a new trial...
