JACOBSON, Chief Judge.

Petitioner, Charles Sutton, originally entered a plea to aggravated assault on July 29, 1981, pursuant to a plea agreement reached with the prosecutor. He was sentenced to an agreed upon maximum term of ten years, with the state agreeing not to allege any prior felony convictions.
