Appellant's first conviction for the December 31, 1977, robbery and murder of James Dewey Cash was affirmed and remanded for proper sentencing in Nelson v. State, 405 So.2d 392 (Ala.Cr.App.1980). The case was subsequently reversed and remanded for new trial, 405 So.2d 401 (Ala. 1981), in accordance with the decisions in
