DENNIS, Justice.

Defendant, Louis Cruz was convicted by a jury of first degree murder, La.R.S. 14:30, but the jury was unable to agree on a penalty recommendation. The trial court in accord with law sentenced defendant to life imprisonment without benefit of probation, parole or suspension of sentence. Defendant appealed.
