The defendant, Dowen P. Chelette, was indicted for the second degree murder of Phyllis Thompson, a violation of La.R.S. 14:30.1. On August 3, 1983, a twelve member jury found the defendant guilty as charged by a vote of 11 to 1. On August 12, 1983, motions for a new trial and in arrest of judgment were denied.
