This is a case of first impression in which defendant Staten Island Rapid Transit Operating Company ("SIRTOA") challenges the existence of federal subject matter jurisdiction over it in a suit brought under the Federal Employers' Liability Act, 45 U.S.C. §§ 51-60 ("FELA"). Plaintiff brought this action to recover $500,000 in damages for personal injuries allegedly sustained by him on December 22, 1982...
