PER CURIAM.

Thomas Baskin appeals pro se from an order of the District Court1 granting the government's motion for summary judgment in Baskin's action for a refund of a tax penalty assessed against him pursuant to 26 U.S.C.A. § 6702 (West Pocket Part 1984). We affirm.
