VAN HOOMISSEN, Judge.

Defendant appeals his conviction for burglary in the first degree. ORS 164.225. He contends that the trial court erred in denying his motion to suppress evidence.1 The dispositive issue is whether defendant was lawfully arrested. We conclude that he was and affirm.
