COOPER, Judge.
This is an appeal from a summary judgment for the appellee, defendant below, in an action seeking damages for negligence. On appeal, the issue is whether the trial court erred, as a matter of law, in ruling that there was no genuine issue as to any material fact, and that the appellee was entitled to judgment as a matter of law.
