DOUCET, Judge.

On June 24, 1981, a train-auto collision occurred which resulted in the death of the driver and one passenger and seriously injured another passenger. In bifurcated and consolidated actions1, the jury returned a verdict in favor of defendant, Missouri-Pacific Railroad Co. (Mo-Pac), and the trial judge rendered judgment in favor of defendant, State of Louisiana.
