Jan M. Tuveson filed suit against the Florida Governor's Council on Indian Affairs, Inc. claiming the Council fired her because she was not a native American Indian. She sought to recover damages for alleged race discrimination under both Title VII of the Civil Rights Act, 42 U.S.C.A. § 2000e et seq., and 42 U.S.C.A. § 1983. The Title VII claim was dismissed on summary judgment on the ground that the Council is not an employer...
