Gould, Inc. ("Gould") filed suit in the Western District of Wisconsin challenging the constitutionality of Wis.Stat. §§ 16.75(8), 101.245 (1981), which blacklist labor law violators. Both parties filed motions for summary judgment. The district court granted Gould's summary judgment motion, holding that the National Labor Relations Act, 29 U.S.C. § 151 et seq.
