OPINION

JACK SMITH, Justice.

Appellant was indicted for attempted murder. The jury found him guilty of the lesser included offense of aggravated assault and assessed his punishment at 5 years confinement, probated for five years.

This offense occurred as a result of two neighbors getting into an argument during a drinking bout. On April 20, 1982, appellant, an off-duty police officer, and complainant, a neighbor, began drinking beer on appellant...
