COUNTISS, Justice.

This is an appeal from a summary judgment that orders appellant Jepthia C. Tyson to pay a portion of his past and future military retirement benefits to appellee Dealva Norine Alexander. Tyson contends various factual and legal issues he raised in the trial court preclude summary judgment. We affirm.
