Plaintiff, Larry Wilson, and defendant, Thomas Beebe appeal the judgment of the district court in this action which was brought pursuant to 42 U.S.C. § 1983 and a pendent state claim of negligence. The district court, based upon the findings and recommendations of a magistrate, dismissed Wilson's section 1983 action, but imposed liability upon defendant Beebe based upon the pendent state claim of negligence.
