OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

McCORMICK, Judge.

Appellant was convicted of the offense of possession of marihuana of less than five pounds but more than four ounces. The jury assessed punishment at ten years, probated, and a $5,000.00 fine. Finding the evidence sufficient, the Eastland Court of Appeals affirmed appellant's conviction in an unpublished opinion. We have granted appellant's petition for discretionary review to consider...
