The primary issue in this appeal is whether or not the plaintiff is entitled to a partition by licitation of certain immovable property and improvements.

The facts giving rise to this case are as follows. Plaintiff, Maggie Mingo Brown, and defendant, James W. Brown, lived together in secret concubinage from December 31, 1954 until November of 1967.
