Robert Smith appeals from the district court's judgment1 dismissing his petition for a writ of habeas corpus filed pursuant to 28 U.S.C. § 2254. Smith contends that the state trial court denied his sixth amendment right to a fair trial by instructing the jury not to consider returning a verdict of not guilty. We affirm.
