McGOWAN, Senior Circuit Judge:

On June 10, 1969 a three-count indictment was returned against appellant, Thomas M. Robinson, charging him with first-degree burglary, petit larceny, and assault with a dangerous weapon. On November 4, 1969 Robinson pled guilty to second degree burglary. Robinson appeared for sentencing on February 17, 1970. At that time the District Court ordered that a study be prepared...
