HALL, Judge.

By grand jury indictment the defendant, Terrance D. Russell, was charged with aggravated rape (LSA-R.S. 14:42) and armed robbery (LSA-R.S. 14:64). After pleading not guilty he was tried before a jury of 12 persons. The jury found the defendant guilty of both offenses, with 10 jurors concurring in the guilty verdicts.
