REAVLEY, Circuit Judge:

John Johnson, Jr. ("John, Jr." or "appellant") appeals his convictions under a threecount indictment of obtaining money by false pretenses, in violation of the federal bank robbery statute, 18 U.S.C. §§ 2113(a) & (b). We affirm as to the first two counts and vacate the sentence on the third count.
