THORNBERRY, Circuit Judge:

Snyder was tried without a jury on one count of conspiracy to secure the escape of a federal prisoner, 18 U.S.C. § 371, and one count of aiding and assisting in the escape of a federal prisoner, 18 U.S.C. § 752(a). He was convicted on both counts and sentenced to serve four years on each count, the sentences to run concurrently.
