STATEMENT OF THE CASE

The defendants, Eugene Tobias and John W. Simmons, were indicted by a grand jury on December 3, 1981, for the second degree murder of Michael Henry. They were tried on June 15 and 16,1982, and found guilty as charged by a unanimous vote of the twelve member jury. Defendants were sentenced to life imprisonment, without benefit of probation, parole or suspension of sentence, on June 30, 1982. Oral motions for appeal were...
