Defendant, Jesse Pendergist, III, was charged by indictment with public bribery in violation of LSA-R.S. 14:118. Upon trial by jury, he was found guilty as charged. Defendant's motion for new trial was denied. Thereafter, the trial court sentenced the defendant to pay a fine of $1,000 plus costs, or in default of payment thereof to be confined in parish jail for a period of ten months.
