John Martin, Sr. appeals his conviction for bringing in and harboring aliens as prohibited by 8 U.S.C. § 1324(a)(4). Appellant was sentenced to eighteen months in prison. The sole issue before this court is whether Martin was denied a fair trial when the prosecutor commented during closing argument upon the absence of two potential defense witnesses.
