PER CURIAM.

Plaintiff appeals as a matter of right from a summary judgment granted under GCR 1963, 117.2(1).

On March 11, 1980, Bernice Fuller filed a complaint for partition of a certain parcel of land located in Independence Township, Oakland County, Michigan. The defendant, Betty Jeanne Fuller, Bernice Fuller's daughter, answered the complaint and, on May 22, 1980, filed a counterclaim asking the court to find the defendant the sole owner of the property...
