OPINION

SPURLOCK, Justice.

Appellant, Vernon Alvin O'Dell, was convicted by a jury of the offense of murder. V.T.C.A. Penal Code, § 19.02. That jury assessed punishment at forty (40) years imprisonment.

We affirm.
