OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

On May 11, 1977, a three count indictment was filed against appellant charging him with breaking and entering a motor vehicle, theft, and credit card abuse by stealing a credit card. Enhancement paragraphs alleging two prior felonies were also included. Appellant was tried before a jury and found not guilty of the breaking and entering offense, but was convicted of stealing the credit...
