SCHOLFIELD, J.

Defendant Louis Russell appeals his convictions for murder in the second degree, attempted murder in the first degree, and rape in the first degree. We affirm.1

Defendant was originally charged with murder in the first degree (premeditated). The first jury, which was instructed on the lesser included offense of murder in the second degree, found the defendant not guilty...
