The plaintiff suffered serious injuries when struck by a motor vehicle in the course of his employment as a construction worker on a highway rebuilding project. After receiving workers' compensation benefits from his employer, a subcontractor, he brought this action in tort against The Barletta Company, Inc. (Barletta), the general contractor on the project.
