This is an appeal from the denial of a petition for writ of error coram nobis seeking to overturn a conviction for the crime of sodomy for which petitioner was sentenced to fifty years in the penitentiary. Petitioner was originally indicted for rape and sodomy involving the same victim. He was represented by retained counsel who advised him that he did not believe he could win his case before a jury.
