John Hovan works for a Rhode Island firm whose employees are represented by Local 94 of the United Brotherhood of Carpenters and Joiners of America ("the Union"). Hovan seeks to join the Union, but he has been denied membership because he will not swear an oath that states, "I am not now affiliated with, and never will join or give aid, comfort or support to any Revolutionary Organization."
