This matter is before the Court upon the cross-motions of the parties for summary judgment. Fed.R.Civ.Pro. 56.

On September 21, 1973, plaintiff Earl L. Brissette filed an application for a period of disability and disability insurance benefits pursuant to 42 U.S.C. §§ 416(i) and 423.
