DOLORES JAMES INVESTMENTS, INC. v. CARDET

No. 82-1983.

431 So.2d 726 (1983)

DOLORES JAMES INVESTMENTS, INC., Appellant, v. Antonio CARDET, Appellee.

District Court of Appeal of Florida, Third District.

May 24, 1983.

Attorney(s) appearing for the Case

Tew, Spittler, Berger & Bluestein and William J. Berger, Coral Gables, for appellant.

McDermott, Will & Emery and Xavier L. Suarez, Miami, for appellee.

Before HENDRY, HUBBART and NESBITT, JJ.

PER CURIAM.

This appeal questions the correctness of a summary final judgment rendered in favor of appellee in an action wherein the appellant sued the appellee for a real estate brokerage commission.

A careful consideration of the record, briefs and arguments of counsel conclusively establishes the absence of any issue of a material fact and that the appellee is entitled to a judgment as a matter of law. Accordingly, the judgment appealed is affirmed.
