Shell Oil Company appeals from a judgment entered for the plaintiff, Mitchell V. Waxler, in an action to recover damages for personal injuries sustained while working on Shell's premises. The plaintiff, an employee of Brown & Root, Inc., was injured in November 1977, while doing construction work for Brown & Root at a refinery plant owned by Shell in Deer Park, Texas.
