The appellant brought this suit in the court below claiming that the appellee violated the terms of a lease entered into between the two. The appellee filed a cross claim against the appellant alleging that the appellant constructively evicted the appellee, thereby breaching the lease and causing the appellee to incur expenses it would not otherwise have incurred.
