Appellant Paul Bush was convicted by a jury of attempting to obtain possession of a controlled substance by misrepresentation, deception and subterfuge in violation of the Controlled Substances Act, Tex.Rev.Civ. Stat.Ann. art. 4476-15 § 4.09(a)(3) (Vernon Supp.1982), [hereinafter referred to as the Controlled Substances Act].
