By a one-count indictment, appellant was charged, while acting in concert with Ralph Tutino and John Ardito, with the crime of conspiracy in the fourth degree. The instant indictment was dismissed as to Ardito after his conviction and sentencing on a separate indictment, which separate indictment was thereafter dismissed in People v Ardito (86 A.D.2d 144). Tutino was indicted in 10 separate indictments related to loan-sharking activities...
